- Seller: Maaskroon BV, trading as Mongmo, registered office in Kortrijk, company number BE1007892356, hereinafter "Mongmo".
- Customer: any business (hospitality, retail, wholesale, company) acting within the scope of its professional activity. These terms do not apply to consumers.
- These terms apply to every quotation, order, delivery and invoice from Mongmo to a customer. By ordering, the customer accepts them.
- The customer's own terms only apply if Mongmo accepts them in writing.
- Deviations only apply if confirmed in writing (including by e-mail) by Mongmo.
Art. 2 – Customer account and access
- Mongmo Pro is accessible by invitation only. Mongmo freely decides which businesses receive an account.
- The customer provides correct company details: name, company number, VAT number, invoicing and delivery address, and contact person.
- The customer keeps its login details confidential. Orders placed through its account are deemed orders of the customer.
- Mongmo may suspend or close an account in case of late payment, misuse or breach of these terms.
Art. 3 – Orders
- Minimum order value: €60 excl. VAT per order. Smaller orders are not accepted.
- Order deadline: no later than 2 working days before the chosen delivery day, before 12:00.
- An order is only final once confirmed by Mongmo and, where prepayment applies, once payment has been received. Mongmo confirms within 1 working day.
- Mongmo may refuse an order in whole or in part, for instance due to limited production capacity or insufficient stock. The customer is informed as soon as possible; any payment for the undelivered part is refunded.
- Changes or cancellations are free of charge until the order deadline. After that, the full order is due, as production has already been planned.
Art. 4 – Prices
- All prices are in euro, excluding VAT and excluding transport, according to the price list linked to the customer account (Horeca, Retail or Wholesale).
- The applicable price is the price at the time of ordering, as shown in Mongmo Pro.
- Mongmo may adjust its prices, for instance due to increased raw material, energy or labour costs. New prices apply to orders placed after the change; the customer is notified at least 14 days in advance.
- Volume prices only apply from the stated quantity per order; the wholesale price applies from 200 units per product per order.
Art. 5 – Payment

- The customer ensures that someone can receive the goods and store them correctly immediately. If no one is present, Mongmo may charge a new delivery.
- Risk passes to the customer upon delivery or pick-up.
Art. 7 – Fresh and frozen
- Frozen is the standard and is delivered throughout Belgium and for export, while stocks last.
- Fresh is only delivered during the fixed delivery rounds in South-West Flanders or picked up in Kortrijk. Fresh products are intended for consumption on the day of delivery.
- Fresh production capacity is limited per delivery round. Once capacity is reached, Mongmo may offer frozen as an alternative or move the order to a following round, in consultation with the customer.
Art. 8 – Storage, food safety and allergens
- Frozen products are delivered at -18°C or colder. From receipt, the customer keeps them continuously at -18°C or colder and must not refreeze thawed products.
- The customer follows the storage, thawing and preparation instructions and the best-before date on the label and product sheet.
- Allergen information is available on the product sheet in Mongmo Pro and on the label. The customer is responsible for passing this information on correctly to its own customers.
- Mongmo produces in an FASFC-registered facility where other allergens are also processed; cross-contamination cannot be fully excluded.
- Mongmo is not responsible for issues caused by incorrect storage, a break in the cold chain or further processing after delivery.
Art. 9 – Complaints and liability
- The customer inspects the goods upon receipt. Visible defects, shortages or a broken cold chain must be noted immediately on the delivery note and reported within 24 hours by e-mail to hello@mongmo-store.com, with photos.
- Hidden defects must be reported within 48 hours of discovery and no later than the best-before date.
- After these deadlines, or once the goods have been processed or resold, complaints are no longer accepted. A complaint does not suspend the obligation to pay.
- For a justified complaint, Mongmo replaces the products concerned or credits their invoice value, at Mongmo's discretion.
- Mongmo's liability is in any case limited to the invoice value of the order concerned. Mongmo is not liable for indirect damage such as loss of profit or turnover, except in case of intent or gross negligence.
Art. 10 – Retention of title, force majeure and final provisions
- Retention of title: the goods remain the property of Mongmo until the invoice has been paid in full, including any interest and costs.
- Force majeure: in circumstances beyond Mongmo's control (such as failure of production or cooling equipment, power cuts, staff illness, extreme weather, traffic disruption or supplier problems), Mongmo may postpone or cancel delivery without compensation. Orders already paid but not delivered are refunded.
- If any provision is invalid, the other provisions remain in force.
- Mongmo may amend these terms. The version in force at the time of ordering applies.
- These terms are governed by Belgian law. Any dispute falls under the exclusive jurisdiction of the courts of West Flanders, Kortrijk division.
